In particular, we provide information on why, how and where we process which personal data. We also provide information about the rights of persons whose data we process.<\/p>\n\n<p>Further data protection declarations and other legal documents such as general terms and conditions, terms of use or conditions of participation may apply to individual or additional activities and operations.<\/p>\n\n<p>We are subject to Swiss data protection law as well as any applicable foreign data protection law, in particular that of the European Union (EU) with the General Data Protection Regulation (GDPR). A <strong>data subject<\/strong> is a person about whom we process personal data.<\/p>\n\n<p><strong>Processing<\/strong> includes <em>any<\/em> handling of personal data, <em>regardless<\/em> of the means and procedures used, such as querying, comparing, adapting, archiving, storing, reading, disclosing, obtaining, collecting, recording, deleting, disclosing, arranging, organizing, storing, modifying, disseminating, linking, destroying and using personal data.<\/p>\n\n<p>The <strong>European Economic Area (EEA)<\/strong> comprises the <a href=\"https:\/\/de.wikipedia.org\/wiki\/Mitgliedstaaten_der_Europ%C3%A4ischen_Union\" rel=\"nofollow noopener\" target=\"_blank\">member states of the European Union<\/a> (EU) as well as the Principality of Liechtenstein, Iceland and Norway. The General Data Protection Regulation (GDPR) refers to the processing of personal data as the processing of personal data.<\/p>\n\n<h3 id=\"rechtsgrundlagen\">2.2 Legal basis<\/h3>\n\n<p>We process personal data in accordance with Swiss data protection law, in particular the <a href=\"https:\/\/www.fedlex.admin.ch\/eli\/oc\/2022\/491\/de\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" id=\"124641\">Federal Act on Data Protection<\/a> (Data Protection Act, DPA) and the <a href=\"https:\/\/www.fedlex.admin.ch\/eli\/oc\/2022\/568\/de\" rel=\"nofollow noopener\" target=\"_blank\">Ordinance<\/a> on <a href=\"https:\/\/www.fedlex.admin.ch\/eli\/oc\/2022\/568\/de\" rel=\"nofollow noopener\" target=\"_blank\">Data Protection<\/a> (Data Protection Ordinance, DPO).<\/p>\n\n<p><span id=\"rechtsgrundlagen-dsgvo\">We process - if and insofar as the General Data Protection Regulation (GDPR) is applicable - personal data in accordance with <em>at least<\/em> one of the following legal bases:<\/span><\/p>\n\n<ul>\n<li><a href=\"https:\/\/steigerlegal.ch\/dsgvo\/dsgvo-6\/\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Art. 6 para. 1 lit. b GDPR<\/a>  for the necessary processing of personal data for the performance of a contract with the data subject and for the implementation of pre-contractual measures.<\/li>\n<li>Art. 6 para. 1 lit. f GDPR for the necessary processing of personal data in order to protect the legitimate interests of us or of third parties, except where such interests are overridden by the fundamental freedoms and rights and interests of the data subject. Legitimate interests are, in particular, our interest in being able to carry out our activities and operations in a permanent, user-friendly, secure and reliable manner and to communicate about them, to ensure information security, to protect against misuse, to enforce our own legal claims and to comply with Swiss law.<\/li>\n<li>Art. 6 para. 1 lit. c GDPR for the processing of personal data necessary for compliance with a legal obligation to which we are subject under any applicable law of Member States of the European Economic Area (EEA).<\/li>\n<li>Art. 6 para. 1 lit. e GDPR for the necessary processing of personal data for the performance of a task carried out in the public interest.<\/li>\n<li>Art. 6 para. 1 lit. a GDPR for the processing of personal data with the consent of the data subject.<\/li>\n<li>Art. 6 para. 1 lit. d GDPR for the necessary processing of personal data in order to protect the vital interests of the data subject or another natural person.<\/li>\n<\/ul>\n\n<h2 id=\"art-umfang-zweck\">3. nature, scope and purpose<\/h2>\n\n<p>We process the personal data <em>required<\/em> to carry out our activities and operations in a permanent, user-friendly, secure and reliable manner. Such personal data may fall into the categories of inventory and contact data, browser and device data, content data, meta or marginal data and usage data, location data, sales data as well as contract and payment data.<\/p>\n\n<p>We process personal data for the <em>duration<\/em> required for the respective purpose(s) or by law. Personal data whose processing is no longer required will be anonymized or deleted.<\/p>\n\n<p>We may have personal data processed <em>by third parties<\/em>. We may process personal data jointly with third parties or transfer it to third parties. Such third parties are, in particular, specialized providers whose services we use. We also guarantee data protection for such third parties.<\/p>\n\n<p>We only process personal data with the consent of the data subject <em>.<\/em>  If and to the extent that processing is permitted for other legal reasons, we may waive the requirement to obtain consent. For example, we may process personal data without consent in order to fulfill a contract, to comply with legal obligations or to protect overriding interests.<\/p>\n\n<p>In this context, we process in particular information that a data subject <em>voluntarily<\/em> provides to us when contacting us - for example by post, email, instant messaging, contact form, social media or telephone - or when registering for a user account. We may store such information in an address book, in a customer relationship management system (CRM system) or with comparable tools. If we receive data about other persons, the transmitting persons are obliged to guarantee data protection for these persons and to ensure the accuracy of this personal data.<\/p>\n\n<p>We also process personal data that we receive from third parties, obtain from publicly accessible sources or collect in the course of our activities and operations, if and to the extent that such processing is permitted by law.<\/p>\n\n<h2 id=\"sicherheit\">4. data security<\/h2>\n\n<p>We take appropriate technical and organizational measures to ensure data security appropriate to the respective risk. With our measures, we guarantee in particular the confidentiality, availability, traceability and integrity of the processed personal data.<\/p>\n\n<p>Access to our online presence, in particular our website, takes place using transport encryption (SSL \/ TLS, in particular with the Hypertext Transfer Protocol Secure, abbreviated to HTTPS). Most browsers indicate transport encryption with a small padlock in the address bar.<\/p>\n\n<p>Our digital communication - like all digital communication <em>in general<\/em> - is subject to mass surveillance without cause or suspicion, as well as other surveillance by security authorities in Switzerland, the rest of Europe, the United States of America (USA) and other countries. We cannot directly influence the corresponding processing of personal data by secret services, police forces and other security authorities.<\/p>\n\n<h2 id=\"ausland\">5. personal data abroad<\/h2>\n\n<p>We <em>generally<\/em> process personal data in Switzerland and the European Economic Area (EEA). However, we may also export or transfer personal data to other countries, in particular in order to process it or have it processed there.<\/p>\n\n<p>We may export personal data to all <a href=\"https:\/\/de.wikipedia.org\/wiki\/Liste_der_Staaten_der_Erde#Tabelle\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">countries and territories on earth<\/a> and elsewhere in the <a href=\"https:\/\/www.datenschutzpartner.ch\/2022\/04\/23\/datenschutzerklaerung-daten-export-universum-mond\/\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">universe<\/a>, provided that the law there guarantees adequate data protection in accordance with the <a href=\"https:\/\/steigerlegal.ch\/2022\/09\/10\/ndsg-schweiz-staatenliste\/\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">decision of the Swiss Federal Council<\/a> and - if and insofar as the General Data Protection Regulation (GDPR) is applicable - in accordance with the <a href=\"https:\/\/commission.europa.eu\/law\/law-topic\/data-protection\/international-dimension-data-protection\/adequacy-decisions_de\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">decision of the European Commission<\/a>.<\/p>\n\n<p>We may transfer personal data to countries whose laws do not guarantee adequate data protection, provided that data protection is guaranteed for other reasons, in particular on the basis of standard data protection clauses or with other suitable guarantees. Exceptionally, we may export personal data to countries without adequate or appropriate data protection if the special requirements under data protection law are met, for example the express consent of the data subjects or a direct connection with the conclusion or execution of a contract. We will be happy to provide data subjects with information about any guarantees upon request or provide a copy of any guarantees.<\/p>\n\n<h2 id=\"rechte\">6. rights of data subjects<\/h2>\n\n<h3 id=\"ansprueche\">6.1 Data protection claims<\/h3>\n\n<p>We grant data subjects all rights in accordance with the applicable data protection law. Data subjects have the following rights in particular:<\/p>\n\n<ul>\n<li><strong>Information:<\/strong> Data subjects may request information as to whether we process personal data about them and, if so, what personal data is involved. Data subjects also receive the information required to assert their data protection claims and ensure transparency. This includes the processed personal data as such, but also information on the purpose of processing, the duration of storage, any disclosure or export of data to other countries and the origin of the personal data.<\/li>\n<li><strong>Correction and restriction:<\/strong> Data subjects can have incorrect personal data corrected, incomplete data completed and the processing of their data restricted.<\/li>\n<li><strong>Deletion and objection:<\/strong> Data subjects can have their personal data deleted (\"right to be forgotten\") and object to the processing of their data with effect for the future.<\/li>\n<li><strong>Data disclosure and data transfer:<\/strong> Data subjects may request the disclosure of personal data or the transfer of their data to another controller.<\/li>\n<\/ul>\n\n<p>We may defer, restrict or refuse to exercise the rights of data subjects to the extent permitted by law. We can inform data subjects of any requirements that must be met in order to exercise their rights under data protection law. For example, we may refuse to provide information in whole or in part with reference to business secrets or the protection of other persons. For example, we may also refuse to delete personal data in whole or in part with reference to statutory retention obligations.<\/p>\n\n<p>We may <em>exceptionally<\/em> provide for costs for the exercise of rights. We will inform affected persons of any costs in advance.<\/p>\n\n<p>We are obliged to take appropriate measures to identify data subjects who request information or assert other rights. The persons concerned are obliged to cooperate.<\/p>\n\n<h3 id=\"rechtsschutz\">6.2 Legal protection<\/h3>\n\n<p>Data subjects have the right to enforce their data protection claims by taking legal action or to lodge a complaint with a competent data protection supervisory authority.<\/p>\n\n<p>The data protection supervisory authority for complaints by data subjects against private controllers and federal bodies in Switzerland is the <a href=\"https:\/\/www.edoeb.admin.ch\/\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Federal Data Protection and Information Commissioner (FDPIC<\/a> ).<\/p>\n\n<p>Possible data protection supervisory authorities for complaints from data subjects - if and insofar as the General Data Protection Regulation (GDPR) is applicable - are organized as <a href=\"https:\/\/edpb.europa.eu\/about-edpb\/about-edpb\/members_de\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">members of the European Data Protection Board (EDPB<\/a> ). In some member states in the European Economic Area (EEA), the data protection supervisory authorities are structured federally, <a href=\"https:\/\/www.bfdi.bund.de\/DE\/Service\/Anschriften\/Laender\/Laender-node.html\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">particularly in Germany<\/a>.<\/p>\n\n<h2 id=\"website\">7. use of the website<\/h2>\n\n<h3 id=\"cookies\">7.1 Cookies<\/h3>\n\n<p>We may use cookies. Cookies - our own cookies (first-party cookies) as well as cookies from third parties whose services we use (third-party cookies) - are data that are stored in the browser. Such stored data need not be limited to traditional cookies in text form.<\/p>\n\n<p>Cookies can be stored in the browser temporarily as \"session cookies\" or for a certain period of time as so-called permanent cookies. \"Session cookies\" are automatically deleted when the browser is closed. Permanent cookies have a specific storage period. In particular, cookies make it possible to recognize a browser the next time it visits our website and thus, for example, to measure the reach of our website. Permanent cookies can also be used for online marketing, for example.<\/p>\n\n<p>Cookies can be completely or partially deactivated and deleted at any time in the browser settings. Without cookies, our website may no longer be fully available. The information is required in order to provide our website in a permanent, user-friendly and reliable manner and to ensure data security and thus in particular the protection of personal data - also by third parties or with the help of third parties.<\/p>\n\n<h3 id=\"zaehlpixel\">7.3 Tracking pixels<\/h3>\n\n<p>We may use tracking pixels on our website. Tracking pixels are also known as web beacons.
